Terms & Conditions

1. This Promotion is organized and promoted by Samsung Gulf Electronics, Concord Towers, 18th Floor, Dubai Media City, Dubai, UAE (the "Promoter"). All participants to this Promotion shall be subject to these Terms or such other terms and conditions that the Promoter may impose. The Promoter reserves the right to amend these Terms without any prior notice to all participants. By participating in this Promotion, Participants shall be deemed to have agreed to and accepted these Terms.

2. This Promotion starts from Tuesday 10th November 2009 8.00am (GMT +4) to Thursday 31st December 2009, 11.59pm (GMT +4), and is open to individuals aged fourteen (14) years and above who are resident in the below specific countries only.

3. Employees of Promoter, its subsidiaries, divisions, affiliates, authorized dealers/distributors, agents and their immediate families are not eligible to enter the Promotion. Promoter reserves the right to disqualify any such person from receipt of any prize and/or require the return of any such prizes awarded. In such an event, Promoter reserves the right to select a new winner for the prize and/or dispose of the prize in any manner it deems fit, at its sole discretion.

4. To enter the Promotion, users have to visit http://www.samsungcorbyme.com and click on the ‘Design & Win!’ button. Users need to create their own Corby design and share with friends to qualify for the draw. All mandatory fields need to be properly completed. Entries submitted by any other means will not be accepted. Acceptance of each entry is at the sole discretion of the Promoter and Promoter reserves the right to reject any entry without disclosing or providing any reason whatsoever. Incomplete or late entries will be disqualified. No purchase is required. Multiple entries are permitted. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

5. The prize for the winners would be a Samsung Corby mobile phone (total six (6) Corby phones). Five (5) winners will be selected from top 20 rated designs and will be entitled to win a Samsung Corby phone along with their winning jacket. One (1) winner will be randomly selected from the participants who rate other participants images.

6. Winners will be notified by the given email address within 15 (fifteen) working days from 31st December 09, using the details provided by the winner. Confirmed winners will have to collect their prize from the designated office as specified in the confirmation email. Winner must personally acknowledge receipt of the prize. In the event that the winner cannot personally acknowledge receipt of the prize, whether due to a failure to comply with these Terms, or if the winner cannot be contacted from the details supplied, then the prize will be deemed forfeited, and Promoter may select another winner from all of the remaining entries at its discretion. Non-compliance with these Terms and any other requirements communicated by Promoter to participants may result in disqualification of the participant and the selection of alternate winners at the Promoter's sole discretion.

7. Each winner will be solely responsible and will bear all costs for any meals, transport, insurance, duties, taxes, licenses, permits, approvals and/or other additional or incidental costs or expenses which may be incurred as a result of and/or related to the winner's acceptance of the said prize(s), including but not limited to any registration fees incurred for the use of any of the prizes.

8. Promoter accepts no responsibility for any variation in the prize value. Prizes awarded in this Promotion may not be exchanged for cash or any other items, provided that Promoter reserves the right to substitute any prize for another prize of similar value. All prizes are non transferable. Substitution of prizes by the winners is prohibited. In the event any winner chooses not to accept his/her prize, the relevant prize will be deemed forfeited, and Promoter may select another winner from all of the remaining entries at its discretion. Promoter's decision regarding the award of all prizes, and/or in every situation including any not covered in these Terms, shall be final and binding on all participants, and no queries, challenges or appeals may be made or entertained. Where required by Promoter, winners and any person sharing the prize with the winner shall be required to complete official release forms prior to the receipt of the relevant prize(s), failing which Promoter reserves the right to forfeit the prize and dispose of the same as it deems fit.

9. Acceptance of any prize shall constitute winner’s consent to allow the use of the winner's name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law.

10. All Promotion entries and all copyright and other rights in such entries and/or other materials become the property of the Promoter and shall not be returned. The participant agrees to provide a written assignment of all rights to the Promoter if requested. By submitting the Promotion entries and any other materials (save for any personal information) to Promoter in connection with the Promotion, each participant thereby (a) specifically authorizes Promoter to use and/or license third parties to use such entry in whole or in part, throughout the universe, in perpetuity in or on any and all media, now known or hereafter devised, and alone or together or as part of other information, content and/or material of any kind or nature; and (b) represents and warrants that all elements contained in the Promotion entry or other material (i) is original to the participant and fully cleared for use as contemplated herein, (ii) does and will not, in any way, violate or breach any of the terms of any other agreement the participant may be a party to, (iii) does not contain libelous, slanderous, defamatory, tortious, or otherwise unlawful, untrue or inaccurate information, infringe or violate any copyright or other right, or contain any matter the publication or sale of which will violate any federal or state statute or regulation, (iv) is not obscene or in any other manner unlawful or likely to cause offense, (v) is not in any way cruel, abusive, nor involved any injury or hurt being caused to animal(s), (vi) is not contrary to or in breach of any internationally or generally accepted principles of human rights, and (vii) shall not require Promoter to pay or incur any sums to any person or entity as a result of Promoter’s use or exploitation of the same.

11. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. If a participant does not truthfully provide all requested personal information, the Promoter may determine that he/she is not eligible to win the prize in this Promotion.

12. If for any reason this Promotion is not capable of being carried on as planned, due to without limitation infection by any computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure, act of God, war (whether or not declared), political coup or insurrection, rebellion, labour dispute, fire, epidemic, storm, flood, typhoon, explosion, legal enactment, government directive, order or regulation, any law or regulation having force of law or any other reason or cause beyond the control of the Promoter, which corrupts or affects the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the process for this Promotion and to disqualify any individual who tampers with the entry process. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer software and/or equipment, failure of any e-mail account or any combination thereof.

13. The Promoter will be entitled at its sole discretion, to terminate or modify the Promotion or to modify these Terms at any time prior to the closing date, by posting the revised Terms on the website.

14. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any death or personal injury suffered or sustained as consequence participation in the Promotion.

15. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with the use of any prizes except for any liability which cannot be excluded by law.
